Acceptance of Terms
Welcome to the David Couser website (the "Site"), an archive of evenings kept by David Couser and Still Sensational in Baltimore, Maryland. By visiting, browsing, signing in, or otherwise using the Site, you agree to these Terms and Conditions. They are the rules of the house, and they apply to everyone who passes through the door.
If you do not agree with any part of these terms, the kindest course is simply not to use the Site. Your continued use signals your acceptance, including of any revisions we make over time, as described in the section on changes below.
These terms work alongside our Privacy Policy and Cookies notice, which explain how the Site handles information. Read together, they describe the whole of the arrangement between you and us.
The Services
The Site is an archive and portfolio. It exists so visitors can revisit the evenings we have documented, not to sell anything. There is no storefront here, no checkout, and no payment of any kind passes through these pages.
Through the Site you may:
- Browse the galleries. A curated archive of photographs from past events, presented as collections to move through at your own pace.
- Watch the recap films. Short films that gather an evening into a few minutes, offered for viewing within the Site.
- Read event information. Notes and details about the occasions in the archive, kept for the record rather than for booking.
- Take part, if you sign in. Leave a comment, place a like, and keep a small profile, as described in the sections that follow.
Everything on the Site is informational. Nothing here is an offer to sell, a quotation, or a transaction, and using the Site creates no obligation to buy or provide anything. We may add to, change, or retire any part of the archive at our discretion.
Accounts & Sign-In
Most of the archive can be enjoyed without an account. If you would like to comment or place a like, you can create one. Sign-in is passwordless: you give us an email address, we send a one-time magic link, and following that link signs you in. There is no password to choose, store, or forget.
Because your email is the key to your account, a few responsibilities come with it:
- Keep your email secure. Anyone with access to your inbox can request a link and sign in as you, so the security of your account follows the security of your email.
- One account per person. Accounts are personal. Please do not create accounts on behalf of others, impersonate anyone, or share a single account between several people.
- Give accurate details. The display name and information you provide should be truthful and yours to use.
You may close your account at any time, and we may suspend or remove an account that is used in breach of these terms. Closing an account also removes the profile, comments, and likes tied to it, as described in our Privacy Policy.
User Content
When you leave a comment or place a like, you are contributing user content to the Site. You keep ownership of what you write. We do not claim your words as our own.
So that your contributions can appear where you intend them to, you grant us a non-exclusive, worldwide, royalty-free license to host, store, display, and reproduce your comments and likes on the Site in connection with the feature you used. This license lasts only as long as your content remains on the Site, and it ends when you or we remove that content.
A few standards keep the archive a pleasant place to be. Content you contribute should be:
- Your own, or something you have the right to share, and not infringing on anyone else's rights.
- Free of unlawful, hateful, harassing, defamatory, or obscene material.
- Free of spam, advertising, or links posted to promote an unrelated product or service.
- Respectful of the people, subjects, and other visitors present in the archive.
We may moderate, edit, or remove any content that falls short of these standards, at our discretion and without notice. We are not obligated to monitor user content, but we reserve the right to do so in order to keep the Site safe and in keeping with its character.
Acceptable Use
The Site is offered for personal, good-faith use. In return, we ask that you not misuse it. When using the Site, you agree that you will not:
- Use the Site for any unlawful purpose, or in a way that breaches these terms or any applicable law.
- Harass, threaten, abuse, or harm other visitors, or post content that does so.
- Infringe the intellectual property or other rights of David Couser, Still Sensational, or any third party.
- Scrape, crawl, harvest, or use automated means to extract content or data from the Site without our written permission.
- Attempt to gain unauthorized access to any account, system, or data, or to probe, scan, or test the Site's security.
- Introduce malware, interfere with the Site's normal operation, or place undue load on it through disruptive activity.
We may take any reasonable steps to address misuse, including removing content, suspending access, or restricting an account, and where appropriate cooperating with the proper authorities.
Intellectual Property
The photography, recap films, written words, the David Couser wordmark, and the design and arrangement of the Site are the intellectual property of David Couser and Still Sensational, or are used with permission. The archive is the work of many evenings, and it remains ours.
You are welcome to view, enjoy, and revisit this work for your own personal, non-commercial use. That permission does not extend to:
- Reproducing, downloading, or redistributing photographs or films beyond ordinary, personal viewing within the Site.
- Using any content for commercial purposes, advertising, or resale.
- Creating derivative works from, or publicly displaying, the content elsewhere.
If you would like to use anything from the archive beyond personal viewing, please ask first. Permission can be requested through the on-site Feedback page, and any use without it is not authorized.
Third Party Services & Links
A small number of trusted providers help the Site work. Accounts, comments, likes, and sign-in are handled through Supabase, which provides the database and authentication on our behalf. By using account features, you also rely on Supabase's services, and its own terms and policies apply to that processing.
The Site may also link out to other places on the web, such as social platforms or external pages of interest. Those destinations are not under our control. We provide links for convenience and do not endorse, and are not responsible for, the content, practices, or terms of any third-party site.
When you follow a link away from the Site, the arrangement described here no longer applies. We encourage you to review the terms and privacy policies of any site you visit.
Disclaimers
The Site and the archive are provided "as is" and "as available", without warranties of any kind, whether express or implied. We make no promise that the Site will be uninterrupted, error-free, secure, or free of anything harmful, and we do not warrant the accuracy or completeness of any information presented.
The archive is a living record. Galleries and films may be added, revised, or retired, and event details are kept for remembrance rather than as a definitive or current account. To the fullest extent permitted by law, we disclaim all implied warranties, including those of merchantability, fitness for a particular purpose, and non-infringement.
Your use of the Site is at your own discretion and risk, and you are responsible for any device or connection you use to access it.
Limitation of Liability
To the fullest extent permitted by applicable law, David Couser and Still Sensational will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of data, goodwill, or other intangible losses, arising out of or relating to your use of, or inability to use, the Site.
This includes anything arising from content you view or contribute, from links to third-party sites, or from any interruption or error in the Site. Because the Site is informational and involves no payment, our total liability to you for any claim relating to the Site is limited to the maximum extent the law allows.
Some jurisdictions do not allow certain limitations, so parts of this section may not apply to you. In that case, our liability is limited to the smallest extent permitted by law.
Changes to These Terms
We may revise these Terms and Conditions from time to time, to reflect changes in how the Site works, the providers we rely on, or the law that applies to us. When we do, we will update the "Last updated" date at the top of this page, which always reflects the most recent revision.
Changes take effect once posted. Your continued use of the Site after an update means you accept the revised terms, so we encourage you to glance over this page now and then. For material changes, we will make a reasonable effort to bring them to your attention.
Governing Law
These Terms and Conditions are governed by and construed in accordance with the laws of the State of Maryland, United States, without regard to its conflict of law provisions. The Site is operated from Baltimore, Maryland.
Any dispute arising under or in connection with these terms will be subject to the exclusive jurisdiction of the state and federal courts located in Maryland. If any provision of these terms is found to be unenforceable, the remaining provisions will continue in full force and effect.
